These Terms of Service ("Terms") govern your use of Rush Battles ("the Game") and related services developed and provided by Aatu Isotalo ("we," "us," or "our"). By accessing or using the Game, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not access or use the Game.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Game for your personal, non-commercial use.
You must be at least 13 years old years old to use the Game. By using the Game, you represent and warrant that you are at least 13 years of age.
4.1. Your use of the Game may require an automatic creation of a user account.
4.2. You are responsible for maintaining the security of your account. You agree to take reasonable precautions to protect your account information and prevent unauthorized access.
4.3. You agree not to share your account with anyone else or allow anyone else to access your account.
4.4. You agree to notify us immediately if you become aware of any unauthorized use of your account or any other security breach.
4.5. We are not responsible for any loss or damage resulting from unauthorized access to your account.
4.6. You may not transfer or assign your account to another individual without our prior written consent.
4.7. You may not use any username that is offensive, vulgar, infringes on the rights of others, or violates any laws or regulations. We reserve the right to suspend your account and reset any username that we deem inappropriate at our sole discretion.
5.1. You agree to abide by our rules of conduct while using the Game. This includes refraining from cheating, exploiting bugs, or engaging in any behavior that disrupts the game experience for others.
5.2. You may not use automated means to access the Game or interfere with the operation of the Game.
5.3. You are solely responsible for your interactions with other players while using the Game.
5.4. You agree not to harass, threaten, or intimidate other players or engage in any form of hate speech or discrimination.
5.5. We reserve the right to suspend or terminate your account if you violate these Terms or engage in any prohibited conduct.
6.1. The Game requires a stable internet connection to function properly. You are responsible for providing and maintaining this connection at your own expense. The quality and availability of your internet connection may affect your experience with the Game, including but not limited to gameplay, loading times, and access to online features.
6.2. You acknowledge and agree that the use of cellular data to connect to the Game may result in data charges from your mobile carrier. You are solely responsible for any costs associated with your use of cellular data.
6.3. We are not responsible for any interruptions, delays, or malfunctions in the Game caused by your internet connection, including but not limited to network congestion, outages, or other technical issues.
7.1. From time to time, we may release updates or patches ("Updates") to the Game. These Updates may include bug fixes, feature enhancements, or improvements to the overall performance and stability of the Game. It is imperative to note that in order to access and use the Game, users must have the latest version installed on their devices.
7.2. Failure to install Updates may result in the inability to access the Game until the latest version is installed. We reserve the right to discontinue support for older versions of the Game. In such cases, users will be required to update the Game to the latest version to continue using it.
7.3. Updates may introduce changes to existing features, gameplay mechanics, user interface, content, or other aspects of the Game. While we strive to maintain a consistent and enjoyable experience for our players, you understand that updates may alter or remove certain features, at our discretion.
8.1. The Game and all related content, including graphics, artwork, and code, are owned or licensed by us and are protected by copyright and other intellectual property laws.
8.2. You may not modify, reproduce, or distribute any part of the Game without our prior written consent.
8.3. Any feedback, suggestions, or ideas you provide regarding the Game may be used by us without any obligation to compensate you.
8.4. You may create and share user-generated content using the Game's features, provided that such content does not violate these Terms or infringe upon the rights of others.
9.1. The Game may offer various in-app purchases that allow you to obtain virtual goods or currency ("In-App Purchases"). These purchases can be made using real money. By making an In-App Purchase, you agree to pay the specified fees and charges associated with that purchase.
9.2. Among the available In-App Purchases, one common type is "gems." Gems serve as a form of in-game currency and can be used to acquire different items and enhancements within the game. It's important to note that In-App Purchases, including gems, hold no real-world value and cannot be exchanged for real currency.
9.3. All transactions involving In-App Purchases are considered final and non-refundable. In the event of a refund, we reserve the right to deduct the corresponding amount of gems from your account, aligning with the value of the refunded in-app purchase.
9.4. We reserve the right to modify or discontinue any In-App Purchase at any time, without prior notice.
9.6. We are not responsible for any unauthorized purchases made through your account.
9.7. Prices for In-App Purchases are subject to change without notice.
10.1. The Game is provided on an "as is" and "as available" basis. We make no warranties or representations regarding the Game's availability, reliability, or suitability for your purposes.
10.2. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Game.
10.3. You acknowledge and agree that we are not responsible for any loss or damage that may result from your use of the Game.
10.4. We are not responsible for any third-party content or services accessed through the Game.
10.5. Our total liability to you for all claims arising out of or related to the Game shall not exceed the amount you have paid, if any, for In-App Purchases.
11.1. We reserves the right to take down the Game servers at any time, for any reason, without prior notice.
11.2. We also reserve the right to cancel the development of the Game and remove it from the AppStore at our discretion. In such cases, we will make reasonable efforts to notify users in advance.
11.3. We are not responsible for any loss of data or progress resulting from the discontinuation of the Game or the removal of the Game from the AppStore.
12.1. We may terminate or suspend your access to the Game immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
12.2. Upon termination, your right to use the Game will immediately cease, and we may delete or deactivate your account and all related information and files.
13.1. These Terms shall be governed by and construed in accordance with the laws of Finland, without regard to its conflict of law provisions.
13.2. Any dispute arising out of or related to these Terms or your use of the Game shall be subject to the exclusive jurisdiction of the courts of Finland.
14.1. We reserve the right to modify or update these Terms at any time. We will notify you of any material changes to these Terms by posting a notice within the Game.
14.2. Your continued use of the Game after any such modifications constitutes your acceptance of the revised Terms.
14.3. If you do not agree to the revised Terms, you may discontinue your use of the Game.
